What this forum is, and what it is not
1.1 Purpose
The purpose of the forum is to allow any interested person to ask a general question about a condition, a technique or a course of care falling within Doctor Frédéric Teboul's specialties, and to obtain general, sourced and understandable information.
It is designed as a place of expertise. It is neither an advertising space, nor a space for testimonials, nor a directory of practitioners.
1.2 No medical consultation
The forum in no way constitutes a medical consultation.
The answers published, including those bearing the "Expert answer" badge, constitute general information for educational purposes. They never constitute:
No physician-patient relationship arises from participation in the forum or from the publication of an answer. Establishing a diagnosis and making a treatment decision require an interview, a clinical examination and, where appropriate, additional tests, in accordance with Articles R.4127-33 and R.4127-35 of the Public Health Code.
In an emergency (trauma, wound, sudden loss of sensation or mobility, severe pain, signs of infection), you should call 15 (SAMU) or 112, or go to the nearest emergency department. The forum is not an emergency channel and is not monitored continuously.
1.3 Free of charge and no guarantee of a reply
Access to the forum and the posting of messages are free of charge. No expert answer is guaranteed, whether in principle or within a set timeframe. The team replies according to its availability and the general interest of the question asked.

Registration and user account
3.1 Registration requirements
Browsing the forum is open and does not require an account. Posting messages requires the creation of an account, which requires:
No other data is required. Using a username that does not allow the user to be identified is strongly recommended given the nature of the topics discussed (see Article 6).
3.2 Minimum age
Registration is reserved for persons aged at least 15 years, in accordance with Article 45 of Law No. 78-17 of 6 January 1978 as amended. Minors under 15 may register only with the joint consent of the holder of parental authority, which must be capable of being evidenced on first request.
3.3 Account responsibility
Each user is responsible for the confidentiality of their credentials and for any activity carried out from their account. Any suspected fraudulent use must be reported without delay to forum@drfredericteboul.com.
Creating multiple accounts by the same person, identity theft and misrepresentation of status (in particular falsely presenting oneself as a healthcare professional) are prohibited.

4.1 General principle
Discussions must remain courteous, relevant and useful to the community of readers. A well-put question benefits the hundreds of people asking the same one.

This rule is not an editorial convenience: it stems from Articles R.4127-31 and R.4127-56 of the Public Health Code, which prohibit a physician from discrediting a colleague, and from Article R.4127-19-1, which prohibits any comparative communication.

4.3 What you should not post about yourself
The forum is public and indexable by search engines. Published messages are visible to everyone, including relatives, employers or insurers.
You are therefore asked not to post:
Phrase your question in general terms. A general question receives a more useful answer than a personal question, which in any case cannot be answered (Article 1.2).
Exchanges concerning an individual situation fall within the scope of a consultation. The forum is not a channel for booking appointments or for post-operative follow-up.
Expert answers and moderation
5.1 The "Expert answer" badge
The "Expert answer" badge identifies answers written or validated by Doctor Frédéric Teboul or by a member of his team authorised to do so.
Expert answers give rise to no remuneration, consideration or partnership. Any potential conflict of interest would be disclosed within the answer itself.
Other user contributions, whatever their quality, bind only their authors.
5.2 Human moderation
The forum is subject to human moderation, with no recourse to fully automated decision-making within the meaning of Article 22 of the GDPR. First-line automatic filters (detection of abusive terms, links and spam behaviour) may place a message on hold, but any decision to remove, suspend or refuse is made by a natural person.
Moderation takes place after publication, as promptly as possible. Messages from recent accounts or flagged by the filters may be held before publication.
5.3 Moderation criteria
Content is removed or made inaccessible when it is unlawful or when it breaches the rules of Article 4. A message may also be moved, renamed, merged with an existing discussion or shortened for readability, without altering its meaning.
5.4 Penalties
Measures are graduated according to seriousness and repetition:
In accordance with Article 23 of the DSA, provision of the service may be suspended, after prior warning, in respect of users who frequently post manifestly illegal content, as may the processing of notices from persons who frequently submit manifestly unfounded ones.
5.5 Notification and appeal
Any decision to remove, suspend or delete is notified to the user concerned, by email, stating the grounds, the basis in these Terms or in law, and the possibility of contesting it, in accordance with Article 17 of the DSA.
An appeal is lodged by email to forum@drfredericteboul.com within thirty days. It is reviewed by a natural person and receives a reasoned response. Judicial remedies remain available.
Reporting content
Any user may report content they consider unlawful or contrary to these Terms, using the report button present on each message or by email to forum@drfredericteboul.com.
In accordance with Article 16 of the DSA, a report is best accompanied by:
An acknowledgement of receipt is sent and the decision taken is notified with its reasons. Reports are handled in a diligent, non-arbitrary and objective manner.
Status of the publisher and liability
7.1 Applicable regime
Contributions published by users are stored at their request and on their behalf. In respect of them, the publisher acts as a hosting service provider within the meaning of Article 6 of the DSA and Article 6, I, 2 of Law No. 2004-575 of 21 June 2004 on confidence in the digital economy.
Its liability for these contributions can only arise if it had actual knowledge of their unlawful nature and did not act promptly to remove them.
The voluntary moderation carried out pursuant to Articles 4 and 5, as well as investigations conducted on its own initiative, do not cause the publisher to lose the benefit of this regime, in accordance with Article 7 of the DSA.
By contrast, the publisher assumes full editorial responsibility for the expert answers and for any content it publishes in its own name.
7.2 Limits
The publisher does not warrant the accuracy, currency or completeness of contributions published by users. It cannot be held liable for the use a user might make of information read on the forum, nor for a decision taken on that basis without medical advice.
Access to the forum may be interrupted for maintenance, updates or security reasons, without notice or compensation. The forum may be removed, in whole or in part, at any time.
7.3 Reduced obligations
The SELARL FREDERIC TEBOUL falls within the category of micro-enterprises within the meaning of Recommendation 2003/361/EC. As such, it is exempt from the obligations of Section 3 of Chapter III of the DSA, pursuant to its Article 19. The obligations of Sections 1 and 2, from which Articles 5, 6 and 7 hereof derive, remain applicable to it and are complied with.
Intellectual property and rights over contributions
8.1 The publisher's content
The architecture of the forum, its graphic charter, the "Expert answer" badge, the expert answers and all content published by the publisher are protected by the Intellectual Property Code. Any reproduction or reuse without prior written authorisation is prohibited.
8.2 User contributions
The user retains ownership of the content they publish.
They grant the publisher, free of charge, on a non-exclusive basis, for the legal term of copyright protection and worldwide, the right to reproduce, display, adapt, translate and archive their contribution:
No contribution is exploited for advertising purposes or transferred to a third party.
The user warrants that they hold the rights to what they publish and that they do not infringe the rights of third parties.

9.1 Processing related to the forum

9.2 The special case of health data
A question asked on the forum may reveal information relating to the health of its author, which constitutes sensitive data within the meaning of Article 9 of the GDPR.
This information is neither requested nor necessary for the operation of the forum: the rules in Article 4.3 expressly ask that it be withheld and that questions be phrased in general terms.
Where a user nevertheless chooses to describe their situation in a public message, the processing of these elements is based on Article 9.2.e of the GDPR, which covers data manifestly made public by the data subject themselves. The forum does not collect this information in the course of an activity of prevention, diagnosis or care on behalf of a third party, and is therefore not subject to the certified HDS hosting obligation provided for in Article L.1111-8 of the Public Health Code.
Elements that manifestly go beyond what the discussion requires, or that make it possible to identify their author or a third party, are removed as a matter of course by moderation.
Health data communicated in the context of a consultation or a course of care follow, for their part, the regime described in the privacy policy and never pass through the forum.
9.3 Account deletion and the fate of contributions
The user may delete their account at any time from their account area or by request to forum@drfredericteboul.com.
Deleting the account results in the erasure of the email address and the anonymisation of the username on published messages.
The contributions themselves may be retained in anonymised form, provided they form part of a coherent discussion thread whose deletion would render meaningless the answers given to other readers. This retention is based on the publisher's legitimate interest in preserving the integrity and usefulness of the knowledge base, within the meaning of Article 6.1.f of the GDPR.
A user may request the outright deletion of a specific message, in particular where it reveals personal details. This request is granted unconditionally when it concerns information relating to the health or identity of its author.
9.4 Your rights
Rights of access, rectification, erasure, restriction, objection and portability, as well as the right to define post-mortem directives: see the privacy policy, which sets out how to exercise them and the possibility of lodging a complaint with the CNIL, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07.
9.5 Indexing by search engines
Public discussions are accessible to search engines and may be reused by third-party services, including generative artificial intelligence systems, over which the publisher exercises no control. Deletion on the forum does not result in the immediate disappearance of copies retained by such third parties.
Amendment of the Terms
These Terms may be amended, in particular to take account of legal, regulatory or functional developments. Any substantial amendment is brought to the attention of registered users by email or by a notice displayed on the forum, at least fifteen days before it takes effect, in accordance with Article 14(2) of the DSA.
Continued use of the forum after that date constitutes acceptance. Otherwise, the user may delete their account under the conditions of Article 9.3.
Governing law and disputes
These Terms are governed by French law.
In the event of any difficulty, the user is invited to contact contact@drfredericteboul.com in order to seek an amicable solution. As the forum is a free service, it does not give rise to a consumer dispute within the meaning of Articles L.611-1 et seq. of the Consumer Code; no consumer mediator is therefore designated for this purpose. Disputes relating to health services are moreover excluded from this mechanism by Article L.611-4 of the same code.
Failing an amicable resolution, the competent French courts have jurisdiction.
